Essay Paper on Legal Issues
One of the most frequent legal issues facing the school district is violence in the schools. Significant component of violent acts occurring in school contexts can be traced either to direct membership in neighborhood groups inclined toward violence or to indirect involvement in a violent subculture outside the school. Violent behavior is perceived as linked to status benefits acquired by the perpetrator; violence toward the teacher is an assertion of the group’s repudiation of the educational system.
The emergence of broadly distributed acts of school violence has been associated with increase in reports regarding the possession of guns and other weapons of violence by students inside the nation’s schools.
At first glance it might appear that the expulsion, suspension, push out and force-out, although certainly tragic for those involved, might be solution to the problem of violence and at least create a somewhat more orderly atmosphere for those remaining in school as a result of the absence of youngsters evidently experiencing problems adjusting to the school environment. The opposite, however, appears to be the case. The vast majority of students who are voluntarily or compulsively excluded from schools do, in time, return to those schools. In many instances their frustrations and inadequacies which caused their absence in the first place have only been heightened by their exclusion and the school community will likely find itself a convenient and meaningful object of revenge.
What is necessary to cure violence and educational ineffectiveness is to make schools more responsive to the needs of children. Schools that arouse frustration and resentment in their students erupt in school crime. Students who resent the rules of unsympathetic adults may seek revenge for perceived unjust treatment. Therefore, starting from the early stages of elementary school curriculum programs must be designed to cover topics dealing with counter violence strategies, such as effective intervention tactics in violent confrontations. Besides, classroom-conducted therapy and counseling in the wake of violent behavior in the school can be an effective solution for children directly exposed to school violence. Also, different types of trainings such as empathy training provided very early in the school experience of children and then systematically expanded in each subsequent year of schooling can lead to lower levels of aggressive behavior of students toward students, and students toward teachers. A key component of trainings related to violence reduction is the early introduction of positive self-evaluation into the thought patterns of students.
